Terms of Service

These terms govern your use of Budget Clan (the "app"). By signing in and using the app, you agree to them. The app also runs on top of services provided by other companies, above all Google; your use of those services is governed by your own separate agreements with them, which we summarise and link under "Third-party services" below.

What Budget Clan is

Budget Clan is a client application that reads and writes expense, budget, and related financial records directly to a Google Sheet created in your own Google Drive. It is not a bank, a financial institution, and does not provide financial, tax, or investment advice. Any totals, reports, or tax-category summaries it produces are calculated from data you entered and are for your own record-keeping only.

Your account and your data

You are responsible for your Google account and for the content of the Sheets Budget Clan creates on your behalf. Because that data is stored in your own Drive rather than on our servers, we cannot recover data you have deleted or a file you have removed access to; keep your own backups as you would for any important document.

Acceptable use

You agree not to misuse the app, including attempting to disrupt it, abusing Google API quotas on shared infrastructure, or using it for any unlawful purpose.

AI features

Optional AI features (receipt scanning, bank statement import, currency conversion) send content to Google's Gemini API, using either your own API key or the app's own AI service (available on paid tiers). AI-extracted data is a best-effort convenience; always review it before relying on it, especially for tax or financial reporting.

Subscriptions & billing

Budget Clan offers a free tier and optional paid tiers. Paid subscriptions renew automatically at the end of each billing period, at the price for that period, and keep renewing until you cancel. The price, the billing period, and the renewal date are shown to you before you buy and remain visible in your app store or payment account afterwards. AI credit packs are one-off purchases and do not renew.

You can cancel at any time through the platform you bought from, using its standard subscription controls. Cancelling stops the next renewal and you keep access until the end of the period you have already paid for. Refunds are handled by that platform under its refund policy.

If you are in the EU or the UK, you have a statutory right to withdraw from a purchase within 14 days of making it. If you asked for your subscription to start straight away and then withdraw inside those 14 days, you pay only for the proportion of the billing period you actually had access to, and we refund the rest. AI credit packs are digital content that is consumed as you use it, so at checkout you will be asked to confirm that supply begins immediately and that you lose the right of withdrawal once the pack is delivered. Where you bought through an app store, that store is the seller and handles withdrawal and refunds directly.

Third-party services

Budget Clan is a client that runs on top of several third-party services. Your relationship with each of those providers is a separate one, directly between you and them, on their own terms. We cannot agree to anything on their behalf and these terms do not sign you up to theirs. What we can do is tell you plainly which providers are involved, what each one receives, and where they hold it:

Each page above links that provider's own terms of service and privacy policy, and states where your data is held. We would encourage you to read the Google one in particular, since signing in to Budget Clan means using your Google account, and that agreement is between you and Google.

Warranty and liability

Budget Clan comes with guarantees that cannot be excluded under the Australian Consumer Law, and with equivalent statutory rights under the consumer law of other countries. Nothing in this section limits or excludes those rights.

Subject to that, and to the maximum extent the law allows: the app is provided on an "as is" basis, we do not guarantee that it will be uninterrupted or free of errors, and we are not liable for indirect, incidental, or consequential loss arising from your use of it.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

Because your records are stored in your own Google Drive rather than on our servers, keeping your own backups of that data is your responsibility. See "Your account and your data" above.

Ending or suspending access

You may stop using the app at any time, including by revoking its access from your Google Account permissions page. You do not need to tell us, and you do not need a reason.

We may suspend or withdraw access to a service we provide ourselves, such as the AI service, if you seriously or repeatedly breach the "Acceptable use" section above, or if we are required to by law. Except where the breach is serious enough that we have to act immediately, or where telling you first would defeat the purpose, we will tell you what the problem is and give you a reasonable chance to put it right before we act. If we do suspend you, we will tell you why and how to ask us to reconsider.

If we suspend or withdraw a paid service and you were not at fault, or the suspension turns out to have been unjustified, we will refund the unused part of what you have paid. Suspension never affects your financial records: they are in your own Google Drive, they stay yours, and the app is not needed to open them.

Changes to these terms

We may change these terms, but only for a reason, and the reasons are these: to reflect a change in what the app actually does; to reflect a change in the third-party services it depends on; to comply with the law or a regulator; to improve clarity or correct an error; or to address a security or abuse problem. We will not use this section to reduce what you have already paid for.

Minor changes, such as clearer wording or a corrected link, take effect when we post them here with a new "last updated" date. For any change that materially affects your rights or what you receive, we will give you at least 30 days' notice in the app or by email before it takes effect.

If you do not accept a change, you can stop using the app, and if you are on a paid tier you can cancel and we will refund the unused part of the period you have paid for. You do not lose anything by refusing: your records are in your own Google Drive and remain readable in Google Sheets without the app.

Your consumer rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, or under the consumer protection laws of the country you live in, where those laws cannot be excluded by agreement. Where such a law applies, it prevails over anything in these terms that conflicts with it, including the sections on warranty, liability, and governing law.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and Budget Clan submit to the non-exclusive jurisdiction of the courts of that State. This does not deprive you of the protection of any law of your country of residence that applies to you regardless of this clause.
